The new presidential administration has issued a wave of executive orders and decisions, among which are several dealing with immigration. Central to these issues is the question of whether officers from Immigration and Customs Enforcement (ICE) can enter various locations to arrest suspected illegal immigrants, including school grounds.

The controversy around ICE at Indianapolis Public Schools
On January 24, 2025, just days after the new administration took office, Indianapolis Public Schools officials issued a statement stressing that they will not allow ICE officers on school grounds without a judicial warrant, according to Fox 59. IPS officials said the district is “committed to fostering a safe, inclusive and welcoming environment for all students and families, regardless of immigration status.”
According to IPS, no unlawful searches and seizures will be permitted on school property. IPS has also said that the district’s staff have been trained to “respond appropriately to situations involving undocumented students and their families” and that the district is collaborating with legal counsel to ensure their actions align with the law.
State officials, however, have pushed back against the district’s actions. Attorney General Todd Rokita has cited Indiana law that prohibits local government entities from placing restrictions on the enforcement of federal immigration law, according to WTHR.
“IPS need[s] to put Hoosiers first and cooperate with ICE or face legal consequences,” said Rokita, noting that the district lacks “discretion to decide whether ICE should receive their cooperation and assistance.”
During uncertain times, make sure you have legal counsel
This controversy here in Indiana is playing out against a backdrop of changes throughout the immigration system on the national level. The new administration is taking steps to radically reshape immigration law, many of which have been challenged in court. It’s unclear how those legal battles will play out and how they will affect immigration enforcement in Indianapolis and throughout the nation.
Meanwhile, the reality on the ground continues to be challenging for immigrants and their families. The immigration courts are heavily backlogged, and the system is confusing and complex at the best of times. It’s important for immigrants and their families to know their rights and understand their options, whether dealing with ICE or facing proceedings in immigration court.
